MUMBAI: It’s time to dolly up, as the crme de la crme of society converges to indulge in their passion for horses and racing at the Mahalakhsmi Race Course here in Mumbai for the Poonawalla Million starting tomorrow.

But it’s not only the horses that are on for a ride here, as more brands are getting involved with the royal sport. Old timers like McDowell’s and newbie’s like Yes Bank and Johnnie Walker are all in the running, vying to capture the hearts and purses of this set.

Though brands like McDowell’s have been involved with the races for the last twenty five years, in the past few years many others have jumped in. “It’s a constant effort on our part to get more brands and companies involved; with each successful event it gets bigger,” states Vivek Jain, chairman of Stewards, and the head of the club’s marketing group.

This year’s Derby day saw first timers like Diageo and Yes Bank saddle up for branding efforts. “Brands get a lot of visibility locally, at the race course, and nationally, since the races are telecast across India”, adds Jain. For the Poonawalla Million Derby, new sponsors include Ma Passion Artefacts Company, Skoda dealers, SBI.

Sponsorship at the races occurs in several ways. McDowell’s sponsors the McDowell’s Derby, where the majority of its Rs. 65 lakh sponsorship goes towards prize money, says Jain.

A newer brand like Yes Bank was co sponsor, hosting the Yes Bank Trophy race and a contest to win Mont Blanc pens. Brands also have tables and displays where people can interact with their products, while others choose to serve drinks and foods associated with their brand.

The race for new brands and sponsors for coming seasons is increasing, with Diageo’s Johnnie Walker vying for the prestigious sponsor of the Derby, and other brands vying for top slots on other classic races.

Whipping up the cash

So, what is it about the races that’s bringing in the crowds, and now the moolah from the brands?

“There is a certain aura about the race course which spells elite: everyone wants to belong to it, therefore it becomes something aspirational for brands,” states Manish Porwal, managing director, Starcom India West and South.

While the audience begins to associate the sponsor brands as aspirational, other brands outside the race course want to join in the brigade. “Brands have a spillover association as well, where when they are talked about in connection with the races in the media, other companies want to be associated with the same”, says Porwal.

Several new brands are already in the running to sponsor the 2008 racing season. “Branding at the race course is inexpensive, and companies are able to entertain clients in a unique environment, different from the usual five star ball rooms,” says Jain.

For Yes Bank, this is the perfect platform to showcase its retail and wealth management business. “Yes Bank is able to engage with high net worth individuals at an informal level about our products: a target group whose attention,

due to media fragmentation, is hard to get in a focused way,” states Isaac Jacob, chief marketing officer country head customer experience, Yes Bank.

Jacob adds they are looking to build unique event properties for future races. Other sponsors like Deutsche Bank held a dinner for their high networth clients, while Nitco Tiles has a party for 2,000 guests on the race course premises. Ritzy brands like Mercedes, Bvlgari, Johnnie Walker etc are leveraging this PR opportunity.

Johnnie Walker is involved not just with the races, but also with the sport of polo. “These tie ups are about showcasing the sub brands of Johnnie Walker like Gold Label” states Santosh Kanekar, marketing head, Diageo.

The aim here is to connect the brands with a property that has the same connotations as the brand values: “Both racing and polo are about luxury, class, indulgence, festivity and celebration: all the values that Johnnie Walker and its sub brands stand for.”

The connection between the brand and its consumer becomes a lot deeper since Johnnie Walker doesn’t only become a sponsor of an existing event, but rather creates a special event around its brand. The Haig Gold Label race day or the multi country Johnnie Walker polo match become properties connected solely with the Diageo brands.

For co sponsors, the rewards are no less: Jacob states that their association with the races gave them great opportunity to engage existing and potential clients for Yes Bank. Porwal explains that geographic localisation and audience segmentation in events like this help brands interact directly with their target. “One can invade mind and heart space at the same time, creating a deep connect without much work.”

The attributes that a brand wants to highlight, along with the interactivity factor help to attract consumer attention at an event. While McDowell’s focused more on the entertainment aspect with dancers and stilt walkers, Casino Goa had faux roulette tables where you could play and win trips to Goa!

Porwal explains that these are the two ways by which brands interact, becoming the “enablers and the celebrators: while a newer brand will enable the audience, helping them understand the sport, a more iconic brand will encourage the consumer to compete, and celebrate with them.”

Kanekar adds, “It is about bringing together the emotional value of the event with the physical experience of the brand.” While Johnnie Walker brought in the McClaren car, and Yes Bank offered Mont Blanc’s, one could win a Bvulgari or a Mercedes if they guessed winners of the races correctly.

This connects brand, consumer and sport: “Creating excitement like this is key for creating brand connect and recall,” states Porwal.

Finally, this kind of sponsorship works not only for brands, but also for the race course. “We want racing to grow and give it a credibility boost, removing the negative stigma that has been attached to it due to gambling etc,” states Jain. And when names like Johnnie Walker, McDowell’s, Yes Bank join,

Expecting a heavy footfall and mindful of limited parking space in the adjacent Yashwant Place, the developers have also constructed a 150 vehicle underground parking for four and two wheelers. Confirming the development, a senior official from New Delhi Municipal Corporation said that the project was awarded to DLF long back and the company plans to launch it sometime this year.

The Chanakya will also host a 20,000 square feet dining area which has been designed by Shawn Sullivan of New York based Rockwell Group. A treat for gourmands of Delhi, it will offer live cooking theatre, gastronomic journey through world cuisines, extensive collection of international wines, tea and coffee. A New Zealand woman has been found frozen to death in the French Alps after rescuers were unable to respond to her climbing group’s desperate calls for help.

She died trying to scale Mont Blanc with her partner a British man and two women from France and Chile.

A statement issued by Ms Jerram’s uncle Jim Jerram today said Jane was keen on outdoor sports.

“Jane had become an accomplished climber during her time living next to the French Alps. She was well trained, meticulous in her planning, including selection of equipment, and was very fit,” Mr Jerram said.

He said details of the accident were not yet known but it appears the climbers were caught on the summit ridge at over 4000m by a sudden storm.

but because of the conditions, a helicopter was unable to reach the four climbers who were found together,” Mr Jerram said.

The climbers were not lost, he said.

The family is travelling to France tomorrow.

Further inside, Antonio simply laughed at the price tags on the Armani suits. “Do you know what Cubans earn?” he asked rhetorically.

Officially, state wages in Cuba are around $25 a month, meaning these shops are intended for foreign visitors or a new brand of wealthy Cuban.

In its heyday the Manzana de Gomez was the finest shopping experience in the Caribbean. Today, it’s the latest step in rebuilding Old Havana, the crumbling colonial centre of the Cuban capital.

What is misuse and neglect?

“Misuse” is where a crofter (or owner occupier crofter) wilfully and knowingly uses the croft for the purpose other than for cultivation or another purposeful use,or where the croft is put to no such use. “Neglect” is where a crofter (or owner occupier crofter) does not manage the croft in a way which meets the standards of good agricultural and environmental condition referred to in Regulation 4 of the Common Agricultural Policy Schemes (Cross Compliance) (Scotland) Regulations 2004

Crofters and owner occupier crofters must cultivate their crofts or else put them to some other purposeful use. “Cultivate” is essentially agricultural use. This includes “the use of a croft for horticulture or for any purpose of husbandry, including keeping or breeding of livestock, poultry or bees, the growing of fruit, vegetables and the like and the planting of trees and use of the land as woodlands. “Purposeful use” means any planned or managed use which does not adversely affect the croft, the public interest, the interests of the landlord or the use of adjacent land.

Should a tenant apply for approval for purposeful use established prior to 1st October?

Yes, the provision for a tenant to use their croft for a purposeful use, other than cultivation, was introduced by the Crofting Reform (Scotland) Act 2007. A tenant must apply to the landlord for written consent before putting the croft to such purposeful use. If the landlord does not consent or applies conditions which the tenant feels are unreasonable, the tenant can apply to the Crofting Commission for consent to the proposed use. The croft should not be put to the proposed purposeful use until consent is either obtained from the landlord or (failing that) from the Crofting Commission.

How strictly will the residency limit be applied?

It is a crofters duty to reside within 32km of their croft (as the crow flies) and the Crofting Commission has a duty to enforce this. In doing so, the Commission will provide the person with notice of the need to comply with this duty and give an opportunity to the crofter to provide an undertaking to do so. In this respect, the Commission has no choice but to adhere strictly to the defined distance set out in the legislation. However, before terminating a tenancy or requiring an absent owner to re let the croft, the Commission will investigate the circumstances of the individual case, to be satisfied that such action would be in the interests of the crofting community.

In cases of misuse and neglect what happens if the owner is asked to let? Does the new tenant have full rights?

Where a beach of duties (for example misuse and neglect) by an owner occupier crofter has been established, the Crofting Commission must, unless there is a good reason not to direct the owner occupier crofter to submit to them, a proposal for letting the croft. In response to that Direction, it is open to the owner occupier crofter to apply to let the croft to a tenant with the full rights retained or they can enter into a contract or agreement with the tenant which excludes certain rights. However, certain rights can only be excluded with the agreement of the Scottish Land Court. Where an owner occupier crofter either fails to provide letting proposals in response to a Commission request to do so or the proposals they provide are unacceptable to the Commission, we will invite applications for letting the owner occupied croft and will decide which of the applicants to let the owner occupied croft to. We will also consult with the owner occupier crofter on what conditions should be applied to the let. Where an owner occupied croft has been let on conditions set by the Commission, the owner occupier crofter may apply to the Scottish Land Court for a variation of the conditions set.

Breach of Duty Who can ask the Commission to carry out an investigation of a suspected breach of duty?

The Commission must investigate whether or not a duty is being complied with where we have received: A report from a Grazings Committee that a tenant crofter or owner occupier crofter sharing in the grazings is not complying with a duty relating to residence, not to misuse or neglect, or to cultivate and maintain; or information in writing from a Grazings Committee, a Grazings Constable, an Area Assessor or a member of the crofting community within which the croft which is the subject of the suspected breach is situated.

Could you provide clarification of the respective positions of tenant crofters and owner occupier crofters in terms of duties and enforcement provisions?

Both tenants and owner occupiers have a duty to reside within 20 miles (32 kilometres) of their croft/s; both have a duty not to misuse or neglect their croft/s; both have a duty to cultivate their croft/s or put it to another purposeful use. Only a tenant would have to apply for consent from their landlord, or if they are unable to obtain the landlords consent, the consent of the Commission prior to putting the land to a purposeful use. If following investigation the Commission establish that a breach of duty in relation to residence, misuse or neglect or land use has occurred, the ultimate sanction for a tenant would be the termination of their tenancy. The ultimate sanction for an owner occupier crofter would be the letting of their croft to a tenant crofter. The owner occupier crofter status would then change to landlord of the croft.

When the Land Court issue an Order under Section 5A(2) that a breach of statutory conditions be remedied, do they make provision for monitoring compliance with the order?

We wouldn expect the Court to take any follow up action once an Order has been issued. If the Commission wish to ensure that a breach has been remedied, the onus is on the Commission to take the necessary follow up action

I am considering purchasing/tenanting a croft and propose to make it my main residence. The croft cannot solely support me and I need to work outwith the community. How does this dovetail with crofting regulation?

Tenants and owner occupier crofters are required to comply with a range of duties specified in sections 5AA to C and 19C of the Crofters (Scotland) Act 1993 as amended. There is a duty to be ordinarily resident within 32km of the croft. If the croft is the sole dwelling and the crofters family are resident while the croft is away this would probably be accepted as ordinarily resident. Other circumstances involving other places of residence would require to be assessed individually. In addition to the duty of residence tenants and owner occupier crofters are required to ensure the croft is cultivated, maintained and not neglected or misused.

What are the duties a crofter may be in breach of?

How does the Commission become involved in a Breach of Duty investigation?

The Commission may initiate investigations itself arising from policy decisions or ministerial directives. The Commission will also carry out investigations in response to reports submitted by specified people or groups.

The Commission can receive notification of a suspected breach of duty from: a grazings committee; a grazings constable; an assessor; a member of the crofting community. If you are not on this list you can submit notification of a suspected breach but we are not obliged to investigate.

1996 03 21 04:00:00 PDT SAN FRANCISCO San Francisco’s Office of Citizen Complaints has rejected theft allegations against a police officer even though a grand jury indicted him for the same charges in a corruption case, The Examiner has learned.

The police watchdog agency’s preliminary decision to drop the complaints against Officer James Acevedo the second such dismissal of a high profile case disclosed this week brought renewed criticism of OCC Director Lance Bayer.

The Examiner reported Tuesday that the OCC had found insufficient evidence to uphold administrative charges against Officer William Wohler in the 1993 shooting death of Brian Sullivan. The City paid Sullivan’s survivors $295,000 last year to settle a suit alleging Wohler wrongfully killed him, though The City did not admit guilt in the case.

Bayer declined to comment on the theft complaint, but defended his tenure.

“Since I’ve been director of the OCC we’ve made some tremendous strides,” said Bayer, an appointee of former Mayor Frank Jordan. “I’m pleased to be of service to this administration and this mayor. I believe I have a great deal to offer.”

In letters dated Feb. 28 to two complainants, Bayer said the OCC had been unable to gather sufficient evidence to uphold their allegations.

Lisa Strain had alleged that in January 1994 Acevedo and several other officers burst into her Western Addition home, held her at gunpoint and stole Cartier perfume, several Mont Blanc pens, a sterling silver pen and other valuables.

Strain and her roommate, Desiree Smith, also alleged that Acevedo and Officer Gary Fagundes came to their new apartment in the Tenderloin in April 1995 and stole a diamond ring, a watch, an electronic organizer and $871 in cash.

Strain and Smith filed their complaints with the OCC on Oct. 10, 1995 less than two weeks after a San Francisco grand jury had indicted Acevedo on two counts of grand theft in connection with the incidents.

The grand jury issued the charges after hearing testimony from the women.

An indictment requires a good faith finding that there is enough evidence to prove the charges beyond a reasonable doubt which is far stricter than the majority of the evidence standard necessary for upholding a citizen’s complaint.

Based on the indictment, then Police Chief Tony Ribera brought his own administrative charges against Acevedo. That case is pending before the Police Commission.

But OCC Director Bayer said in his Feb. 28 letters to the two women that the OCC investigation “failed to disclose sufficient evidence to enable us to determine the validity” of the allegations.

Jeffrey Sloan, the lawyer for the two women, said the OCC had failed to investigate the case thoroughly and hadn’t even interviewed Smith. He said he’d seek a further hearing.

The women said Wednesday they felt betrayed and humiliated by the OCC’s findings.

“It’s like a slap in the face,” Smith said. “I’m a little outraged. For the OCC to find no problem . . . I don’t see how that could happen.

“It makes you kind of have doubt in the whole system,” the 25 year old artist said.

Strain, 30, a retail clerk, said she felt twice victimized first by the police, then by the OCC.

“This has been very difficult,” she said, adding that the police have yet to return her property.

“They (officers) went from the jewelry box to the closet, back and forth,” she said. “I felt like the mini mart they came in and took what they wanted.”

The OCC also failed to find evidence to sustain the women’s complaints against Fagundes and Officer Steve Landi.

Acevedo, 46, is scheduled for trial next Wednesday in Superior Court for allegedly stealing from the women. Fagundes, 42, and Landi, 40, face charges of stealing from other people. All were on a special anti drug team. Each has pleaded not guilty.
